'Made' Plan

On 29 November 2018 North West Leicestershire District Council 'made' the Neighbourhood Plan.  It should now be used to help determine planning applications within Ashby de la Zouch.

As required by the neighbourhood planning regulations the Decision Statement (PDF Document, 0.27 Mb) has been published.

Paper copies of the Neighbourhood Plan and Decision Statement can be viewed in Ashby de la Zouch library and at the District Council offices in Coalville.  

Referendum

The Ashby de la Zouch Neighbourhood Plan Referendum took place on Thursday 22 November 2018.

The question asked at referendum was: Do you want North West Leicestershire District to use the Neighbourhood Plan for the Ashby de la Zouch Neighbourhood Area to help it decide planning applications in the Neighbourhood Area?

The result was:

No - 183

Decision Statement

The Examiner's report concludes that, subject to making proposed modifications, the Neighbourhood Plan should proceed to a Neighbourhood Planning referendum.  The Qualifying Body have approved the Examiner’s recommendation for the amendments to the plan.

On 7 September 2018, the District Council, agreed to proceed to referendum on the draft Ashby de la Zouch Neighbourhood Plan.  As required by the Neighbourhood Planning (General) Regulations the Ashby de la Zouch Neighbourhood Plan Decision Statement (Word Document, 0.15 Mb)  has been published.

Independent Examination

The District Council collated all the representations received at submission stage and passed them on to the Independent Examiner, who led the Examination.  The independent Examiner was looking at the responses received and the Neighbourhood Plan documents to assess whether the Plan met the Basic Conditions and could proceed to referendum. 

Following the decision of the Court of Justice of the European Union (CJEU) in the matter of People Over Wind and Sweetman v Coillte Teoranta (C-323/17) and the related guidance “Consideration of avoidance and reduction measures in Habitats Regulations Assessment: People over Wind, Peter Sweetman v Coillte Teoranta”  the Examiner and the District Council agreed on 25 June 2018 to pause the Examination until an update of the Habitats Regulation Assessment of the Neighbourhood Plan could be completed which would take into account this judgement.  The update was completed by AECOM in July 2018, and was submitted to the Examiner.  It can be viewed below (please note this version replaces an earlier version submitted to the Examiner in July 2018):

Submission Neighbourhood Plan

In August 2017, Ashby Town Council submitted the Ashby de la Zouch Neighbourhood Plan to the District Council. In accordance with Section 16 of the Neighbourhood Planning (General) Regulations 2012, North West Leicestershire District Council then consulted on the neighbourhood plan. The consultation period ended on 11 October 2017.

Pre-Submission Consultation

Having completed the draft of their Neighbourhood Plan and stage 1 pre-submission consultation in 2014, in March 2017 Ashby Town Council undertook Phase 2 of the pre-submission consultation required by the Neighbourhood Planning (General) Regulations 2012. Neighbourhood Area Designation

In December 2013 Ashby de la Zouch Town Council applied to North West Leicestershire District Council for designation of a Neighbourhood Plan Area under Part 2 of the Neighbourhood Planning (General) Regulations 2012. Details of the application can be viewed below:
