Do I Need a Consent if I Don’t Trade Within Any of the Zones?

No. A consent is not needed in these circumstances

Do I Need a Premises Licence Under the Licensing Act 2003 Even Though I Have a Street Trading Consent?

Yes. The Street Trading legislation and the Licensing Act 2003 are independent pieces of law. As an example if you want to sell burgers in Coalville town centre after 11pm you will need a Street Trading consent and a Premises Licence authorising you to sell late night refreshment.

I Currently Run a Burger Van Operation on a Private Industrial Estate. Do I Need a Street Trading Consent?

Street Trading does not apply to trading on private land. However, if the van, stall barrow etc is situated on private land at the edge of the public road and sales are being made to pedestrians on the public highway you will need a consent to trade. As with any law there will be 'grey' areas and if you feel that your circumstances are different please contact the Licensing Office for a decision.

I Have a Hot Food Road Side Cafe on the B4116 Near Measham. Do I Need a Consent?

No. The only roads that need a consent are A444, A511, A42 (although no trading is allowed on this road under any circumstances), A512, A6, A50, A453 and A447.

I Have a Road Side Cafe on One of Your 'Major Roads' and I Have Been Operating in the Same Place for Several Years. Will I Get Preferential Treatment That Will Allow Me to Continue Trading in the Same Place?

You will get special treatment so long as you get your application form submitted before 6 April 2009. If you do you will be allowed to trade until your application is determined (which will be after 6 April). You will also be allowed to trade from the same pitch. If you fail to get your application in on time you will have to cease trading from 6 April 2009 until the application is determined. Any applications for your site will also be considered.

I Think Its Unfair That I Have to Pay for a Consent to Sell Ice Creams at My Local School. Why Have Schools Been Included in the Consent Scheme?

A street trader caused a lot of problems at a local school by selling to children. The litter and general disruption to those living nearby was quite upsetting. In response to the issues raised it was felt that a consent would be required for all local senior schools and colleges.

What Happens if I Trade After 6 April 2009 Without a Consent?

You may be trading illegally and you may leave yourself open to legal proceedings.
